  54. explode; in my paranoiac manner i cling to the ideal of "free speach"
  55. and the notion that free speech is write, because if i don't cling to
  56. something i'll drown in legalisms and mannerisms.  eek.  !  .  I risk
  57. being subsumed by popular culture.

  84. Well, it seems the drubbing "Joe" took in R19SYSOP wasn't enough for
  85. him; he took it to the 'snooze, complete with the original complaints
  86. he'd had that we'd cleared up for him.
  87.  
  88. Guess it's time to do it again.

  90. His two major complaints in this forum were:
  91.  
  92. 1) That by displaying Fidonews, he lost his sectarian job.  (Funny,
  93. don't recall that being mentioned in R19SYSOP, but I'll address it
  94. anyway.)

  96. 2) That Policy 4 requires him, as NEC, to carry Fidonews.
  97.  
  98. I'll address number 2, first, just to get it out of the way; no,
  99. it doesn't.  Period.  We all told Joe this in R19SYSOP, but I
  100. guess he didn't choose to believe it.  The R19C even told him.
  101.  
  102. On to point number 1.  Joe, I suggest that if this incident REALLY
  103. happened, you sue them.  They haven't a leg to stand on, because

  106. NOTHING ILLEGAL WAS PRINTED IN FIDONEWS.  You have claimed that
  107. there was more than once, but you're quite simply WRONG.
  108.  
  109. Nothing in Policy requires you to carry Fidonews; nothing in Policy
  110. requires you to read Fidonews.  Nothing in the law prevents anything
  111. that has been published in Fidonews from being displayed in the forum.
  112.  
  113. Nothing in the law prevents anything that has been published in
  114. Fidonews from being displayed to MINORS.
  115.  
  116. BBSes are not something that "intrudes into people's homes" through
  117. "public airwaves."  You have to make an effort to get there, and
  118. few 12-year-olds purchase their own modems.  If a parent chooses not
  119. to supervise his youngster's BBS access, that is his RIGHT as a
  120. parent, regardless of what level of scrutiny *YOU* feel he should
  121. exercise.
  122.  
  123. Don't want to display Fidonews on your BBS?  Fine; don't!  Don't want
  124. to receive it; fine, tell your NC.  I'm 100% certain he'll be happy
  125. to not send it to you.
  126.  
  127. Don't you *DARE* tell the rest of us what we're allowed to read, and
  128. what is too "dangerous" for our tender little eyes.
  129.  
  130. Words don't hurt children, Joe; ideas can, but those exact same ideas
  131. can easily be expressed with different words.  Obviously the ideas
  132. aren't the problem, or you wouldn't be so hung up on the words.
  133.  
  134. Don't ever presume to tell OTHERS how they HAVE to raise their
  135. children, Joe; you can tell them how you THINK they should, but you
  136. have no right to force it on them.
  137.  
  138. BTW, go ask a lawyer; if you display any issue of Fidonews that has
  139. ever been printed on your BBS, and a kindergarten-age child reads it,
  140. there is no legal liability to which you can be held.  If your church
  141. tells you different, it's either because they don't know what they're
  142. talking about or because they know you don't.
  143.  
  144. As for Policy 4 requirements, they're quite simple; I know you know
  145. this now, but I'll restate it for the net.
  146.  
  147. If you are a *C  (note the lack of an "E" in that) you MUST obtain
  148. Fidonews on a weekly basis, and make it available to those under you.
  149.  
  150. That does not mean you must allow it to be downloaded or even FREQed
  151. by those outside your coordination area; just that you must make it
  152. available to those within it who want it.
  153.  
  154. If that requirement is not palatable to you, then you have two
  155. recourses:
  156.  
  157. 1) See to it that they are provided with Fidonews through another
  158. means.  As long as they get it, you're fulfilling your job.
  159.  
  160. 2) Resign the position; being NC of your net isn't a right, it's a

  163. privilege.
  164.  
  165. Restricting everyone else to YOUR limited vocabulary isn't an option.
  166.  
  167. Doing something to make it deliberately difficult to obtain Fidonews,
  168. such as the "available between 01:00 and 01:01 once a week" idea I
  169. recently saw, is subject to *C interpretation but I believe you'll find
  170. that it would be considered deliberately annoying behavior, and
  171. excessively annoying if repeated.
  172.  
  173. Bottom line; not reading it is choice.  Trying to keep others from
  174. reading it is censorship.  If you're willing to take a stance that
  175. other's right to send articles to the snooze is ok to restrict, then
  176. don't expect any sympathy on YOUR claims of rights.

  178. As for the editors of Fidonews, they're doing a damn fine job of the
  179. minimalist editing NECESSARY on this sort of publication.  Nobody has
  180. been allowed to post credit card numbers, or advertisements for
  181. illegal activities.  Other than that, they should (and do) reformat the
  182. margins and get the hell out of the way.

  192. RC2:25 (about whom a lot has been said recently) decreed that as
  193. from about two weeks ago region 25 would be organized geographically
  194. in accordance with policy.
  195.  
  196. RC25's interpretation of both Policy and Geography.
  197.  
  198. RC25's implementation was simple - dictate a nodelist segment to
  199. each NC, and if they don't use it, reject the submitted net update
  200. and use RC25's interpretation of that nets segment.
  201.  
  202. Some nodes are staying where they are, and some nodes are moving.
  203. Some of these object to moving, some don't. Some NCs are refusing to
  204. implement moves.
  205.  
  206. Chaos Ensues. Some Sysops are losing a nodelisting through their own
  207. stubbornness, and others are losing a nodelisting through the
  208. refusal of their NC to implement the required changes.
  209.  
  210. Interesting policy question - if NCx knowingly submits a net segment
  211. that RCy refuses to process because that net segment is 'non policy
  212. compliant' in RCy's view, who is denying connectivity to a new node
  213. in that net segment?
  214.  
  215. (There are two answers - depending on whether you ask a pro or anti
  216. reorganisation supporter)

  220. I don't agree that forcing the issue by dictating net segments to
  221. NCs is the way an RC should implement policy. But, if it's a choice
  222. between running with the tide now and (hopefully) having some input
  223. on a policy referendum, or losing all chance of that input, I'm
  224. staying put.

  226. What happens now? Some sysops are using their old (no longer
  227. nodelisted) addresses, some sysops are using "alternative"
  228. nodelists, some sysops are using the ZC2 issued nodelist, some are
  229. using multiple nodelists - we have complete chaos with netmail and
  230. echomail routing and will have for some weeks - probably well into
  231. the new year, not to mention the hassle of trying to keep up with
  232. stacks of address changes in all our routing / control / password /
  233. modem (etc) files that people aren't telling us about because they
  234. don't want to move.

  236. Hey, listen up you guys - I may not agree with the way things have
  237. been done, but if you all want to maintain connectivity - the best
  238. thing to do is accept it and fight from the inside - not try and
  239. force your opinion in from the outside.

  243. Oh, and one or two other points from Issue 10/48.

  245. (1) I've never heard of *any* policy that requires *any* *EC to
  246. distribute the snooze - have you?
  247.  
  248. (2) Why does a world-level policy document have to say how NCs, RCs
  249. and ZCs are selected? Those should be dealt with in Net, Regional
  250. and Zone policies.

  264. I read the document and was interested in a clarification regarding the
  265. following section which I will quote fully below:

  278. As some of you may already know, there is a fairly high profile
  279. publication ban here in Ontario, Canada. At issue is the trial of
  280. one Karla Teale (Homolka maiden name). Apparently she and her husband
  281. Paul Teale (formerly Bernardo) were involved in the deaths of at
  282. least 2 young teenage girls.
  283.  
  284. Karla was convicted of manslaughter (many think it should have been
  285. murder) and received a sentence of 12 years in prison....which means
  286. she is eligible for day passes to the mall in two years...and full
  287. parole in 4 years. Her husband Paul has yet to be tried. Supposedly
  288. to ensure that he receives justice, the local judge ordered a
  289. publication ban on details from Karla's trial.
  290.  
  291. Many  rumours  are  circulating  regarding the details of the
  292. deaths.....there were 11  months  in  between  the  two  main
  293. deaths.....and Karla's younger sister apparently died of choking on
  294. her own vomit.....under suspicious circumstances...and her body was
  295. exhumed recently.

  297. Some of the rumours involve torture, snuff films, bestiality and
  298. inscest....the citizens of Canada and particularly Ontario...can't be
  299. sure what is true or not....the judge in the case BANNED THE PUBLIC
  300. from the courtroom (secret trials???????) and placed a GAG ORDER ON
  301. THE  PRESS that were allowed in.....the local authorities are
  302. enforcing the publication ban and threatening to prosecute anyone who
  303. reveals banned details......
  304.  
  305. Banned details and discussions about the trial were first heavily
  306. discussed through modems and computers linked to various networks
  307. including Fido boards.
  308.  
  309. Recently, many US media outlets have started carrying banned details
  310. about the case.....the Ontario Attorney General Marion Boyd is
  311. decrying  the  fact  that the American media is covering the
  312. story....but they are beyond her jurisdiction.
  313.  
  314. What I would like to know is how would such an issue be handled by
  315. this proposed policy document?  Is it an issue under the existing
  316. Policy 4?
  317.  
  318. The Chachi-Piruli document clearly states that illegal activity is
  319. grounds for barring someone from the net. If people are using the
  320. Fidonet to break the ban and thus the law, will they get the boot?
  321.  
  322. But what is illegal in one juridiction may not be in another. Who
  323. decides?  What about free speech? Do we let the local authorities
  324. dictate what we can talk about on the net? Do we block out or censor
  325. echomail  that may contain banned details before it enters a
  326. particular jurisdiction?

  328. There are forces too numerous to enumerate that are furiously working
  329. to implement "group-think" and control what we can say etc. I have
  330. always found this medium to be a liberating one. I would hate to see
  331. it knuckle under the whims of an unelected magistrate with a weak

  372. wind?  I mean, lets face it, anal sex (and oral for that matter)

  408. Sorry this message is crude, but I don't have a copy of your  message
  409. submission file to reference.

  411. As  an older Sysop, I've been around to watch these "chain-mail" text
  412. files and programs come and go. I've now found  something  old  being
  413. done a different way.
  414.  
  415. What  I'm  talking about is the fact that a LOT of SysOps have locked
  416. out certain filenames, and segments  of  filenames  due  to  possible
  417. legal problems, and just the fact that they don't want these files on
  418. their boards.
  419.  
  420. I, myself, have locked out the following filenames:
  421.  
  422. MAKEMONY.*
  423. CASHFLOW.*
  424.  
  425. and, a few others. Those were the  2  biggest  offenders.  They  both
  426. required  you  to send 5 1-dollar bills off to the first 5 names on a
  427. list, and then  add  your  name  to  the  bottom.  CashFlow  does  it
  428. electronically,  so you send the money off, and upload the archive to
  429. other boards. MAKEMONY normally went into EchoMail  conferences,  and
  430. most  moderators  took a very dim view about this practice. (The text
  431. file TOLD  people  to  do  that,  and  even  suggested  National  and
  432. International  conferences  as  the  best  places.)  They seem to get
  433. around the legal stuff by saying that they are helping you compile  a
  434. mailing  list.  While  this  isn't illegal, the methods, and verbage,
  435. lend an air of mis- belief to the whole thing. The  extensive  stress
  436. on  ensuring  the people MUST do the steps EXACTLY, or they might not
  437. get anything back makes me boil.
  438.  
  439. Anyway. Here's some info, so other Fido Sysops don't get bit by  this
  440. file.  Reason  I'm  doing  this  is an old adage. "What's legal here,
  441. might be illegal elsewhere." If someone downloads this  archive,  and
  442. the  local  laws make it illegal, then you might be held responsible.
  443. Also, please remember that this archive used to be named  "CASHFLOW",
  444. but  the  reason  why  they  changed  it will be in the next message.

  496. to the author about a little dilemma involving BBS operators forbidding the
  497. uploading of files containing the words CASH found anywhere in their
  498. filenames, and Jeff advised me to change the names and add this file and
  499. request that it always be sent along and zipped up with HOMEBASE.COM
  500. and HOMEBASE.DAT into a filename preferably HOMEBASE.ZIP.

  508. Rather than re-write the complete HOMEBASE.COM program, I was told to
  509. inform all recipients of this file, not to mention TONS OF MONEY, that
  510. anywhere you see instructions using the word CASHFLOW, be it .com or .dat
  511. or .zip, you *** M U S T *** pretend that the word CASHFLOW **REALLY**
  512. means ---> HOMEBASE <-- and always use this name instead. That's really
  513. fairly simple, but one little slip could cost you thousands of dollars if
  514. you were to upload any file with the words CASH in them. SO DON'T !!!!
  515. You might think you're home free if the BBS you frequent will allow the
  516. upload of a file with the word cash, but if it can't be guaranteed that it
  517. is uploadable to other BBS's, your potential income could suffer miserably.

  523. When uploading the file to other boards (the more the better!)and asked
  524. to give a description of the file, do yourself a BIG FAVOR and make the
  525. file sound enticing WITHOUT USING words like "get rich" or "fast money".
  526. Any mention of the words pertaining to money or cash or profits could throw
  527. alot of your efforts right down the drain. Now who would want that??
  528. Instead, maybe use a line similar to this to describe the file "INNOVATIVE

  629.   I may be just missing a vital piece of policy that I should
  630. have read here but I was just wondering how to file a greivance
  631. (sp) or complaint against a heavy handed, dictator type of echo
  632. moderator. I am currently on 4 different networks and have
  633. noticed on every network that there are some very egotistical
  634. and power mad echo moderators. The current policies regarding
  635. moderators states that the moderator has final say in all
  636. matters concerning his/her echo. This is fine as long as the
  637. moderator is right and just. But what happens when the moderator
  638. isn't? Some well meaning user who is abiding by the rules get
  639. publicly admonished for doing something wrong that he didn't do.
  640. This user defends himself to the moderator and then has his feed
  641. cut for daring to insinuate that the moderator was wrong. There
  642. should be some recourse for egotistical moderators to be delt
  643. with. Absolute power corrupts absolutely. This is a fact. Read
  644. just about any echo on just about any network and you will find
  645. some moderator admonishing some user. Most times their right in
  646. doing so, but sometimes their not. Moderators aren't gods, their
  647. moderators.

  680. the Comics Echo. Comics generally considered as something for kids
  681. right? Well, last month there was a nice long thread about the size

  684. The Japanese Animation (Anime) conference currently has a nice thread
  685. going about nudity. Several people on it continuously are at each
  686. others necks arguing over which is the best voice for Priss.

  690. And last time I checked, most 10 year olds can barely comprehend what
  691. is said in a newspaper.
